Employment discrimination occurs when an employer makes an adverse employment decision based on an employee’s protected class. Protected classifications include race, color, religion, national origin, sex, pregnancy, disability, and age. Federal and state laws prohibit employment discrimination and have some overlap in protected classifications. To state a claim for discrimination, you must adequately allege that you are a part of a protected class, that you were meeting the legitimate expectations of your employer, that you suffered an adverse employment action, and finally, that similarly situated employees that are not members of the protected class were treated differently than you. Federal laws include the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and Title VII of the Civil Rights Act of 1964.
